Investors were required to commit a minimum of $5 million in collateral (or a mandate) for the CYES option overlay strategy. In addition to paying commissions for each option trade and an annual fee of .5% of the collateral mandate, CYES investors also would pay a fee of 10% of any profits derived from the strategy. In short, Merrill Lynch was certain to profit handsomely from its sales of the Harvest CYES program, while investors were subject to significant risk.
